Details:

The eligibility requirements apply equally to marriage certificates and certified copies of Registrations of Marriage. 
 
Only eligible applicants may order (and reorder) Vital Statistics documents. Under no circumstances does a registry agent employee have the authority to order or reorder Vital Statistics certificates/certified copies on behalf of someone without that person’s knowledge and signature on the application form. 

Eligibility Exception

The following eligibility requirements do not apply after 75 years from the date of marriage. After 75 years, anyone may apply for the certified copy of a Registration of Marriage. Until a record is that old, eligibility is restricted and these eligibility requirements apply. There are no exceptions.

Eligibility Categories

The following individuals may apply for marriage certificates/certified copies of Registrations of Marriage when the corresponding proof of eligibility is provided. Contact Vital Statistics if you are uncertain of a person’s eligibility. 
1.  The Person whose marriage is registered.

2.  A Guardian or Trustee of the person whose marriage is registered.

• The guardianship/trusteeship document must provide the authority (or not negate the authority) to make application for a marriage record; e.g., the document only authorizes banking privileges.
• A copy of the guardianship court order or proof of trusteeship must be attached to the application form. 

3.  An individual who holds a Power of Attorney to act on behalf of the person whose marriage is registered. 

• The applicant must be identified in the power of attorney.
• The power of attorney document must provide the authority (or not negate the authority) to make application for a marriage record; e.g., the document only authorizes banking privileges.
• A copy of the power of attorney must be attached to the application form.

4.  A Designated Agent on behalf of an eligible person (#1 to #3).

• The applicant must have known the Designated Agent for at least one year.
• The Applicant’s Consent to Designated Agent on the application form must be completed by an eligible applicant (#1 to #3).
• The Designated Agent’s Statutory Declaration on the application form must be solemnly declared by the designated agent.
• The original Consent and Statutory Declaration (if separate documents) must be attached to the application form.

5.  An individual named the agent in a Personal Directive of a person whose marriage has been registered.

• Fax a copy of the Personal Directive to Vital Statistics for evaluation.
• Vital Statistics will advise if the applicant is eligible. See Contacting Alberta Vital Statistics.
• The Personal Directive must show the applicant as the agent.
• A copy of the Personal Directive must be attached to the application form when the applicant is eligible.

6.  An individual who has an Alberta Court Order that states he/she may make an application for a particular certificate/certified copy of a Registration of Marriage.

• The applicant must be named in the court order as authorized to make application.
• The court order must state whose certificate/certified copy of a Registration of Marriage is being released.
• A copy of the court order must be attached to the application form.
• Record the court order number in the Service Request Notes on VISTAS.

7.  A Lawyer acting on behalf of any of the above eligible applicants (#1 to #6), when obtaining the marriage record is required as part of the service the lawyer is providing.

• A copy of the lawyer’s valid Law Society card must be attached to the application form.
• The application must indicate who of the eligible applicants (#1 to #6) the lawyer is applying on behalf of.
• A person working in the same law office as the eligible lawyer may make the application on the lawyer’s behalf. The person must show proof he/she is employed by the same law firm as the lawyer. A copy of the proof (e.g., the person’s business card, pay stub, letter of employment, etc.) must be attached to the application. This is in addition to the copy of the lawyer’s Law Society card.

First, obtain a valid Alberta corporate name search (NUANS Report) from CNN that’s valid for 90 days.  The NUANS name you are reserving should be in the following format:

Second, fill out your Articles of Incorporation found on our website under “Useful links” then “Forms”  or simply follow this link;
