<p><span style="color: #000000;">The eligibility requirements apply equally to marriage certificates and certified copies of Registrations of Marriage. <br />

</span><span style="color: #000000;">Only eligible applicants may order (and reorder) Vital Statistics documents. Under <strong><span style="font-family: Times New Roman;">no</span></strong></span><span style="color: #000000;"> circumstances does a registry agent employee have the authority to order or reorder Vital Statistics certificates/certified copies on behalf of someone without that person&#8217;s knowledge and signature on the application form. </span></p>
<p><strong><span style="color: #000000;">Eligibility Exception</span></strong></p>
<p><span style="color: #000000;">The following eligibility requirements do <strong><span style="font-family: Times New Roman;">not apply</span></strong></span><span style="color: #000000;"> after 75 years from the date of marriage. After 75 years, anyone may apply for the certified copy of a Registration of Marriage. Until a record is that old, eligibility is restricted and these eligibility requirements apply. There are <strong><span style="font-family: Times New Roman;">no</span></strong></span><span style="color: #000000;"> exceptions. </span></p>
<p><strong><span style="color: #000000;">Eligibility Categories </span></strong></p>
<p><span style="color: #000000;">The following individuals may apply for marriage certificates/certified copies of Registrations of Marriage when the corresponding proof of eligibility is provided. <strong><span style="font-family: Times New Roman;">Contact Vital Statistics if you are uncertain of a person&#8217;s eligibility</span></strong></span><span style="color: #000000;">. </span><span style="color: #000000;"><br />
</span><span style="color: #000000;">1.  The <strong><span style="font-family: Times New Roman;">Person</span></strong></span><span style="color: #000000;"> whose marriage is registered. </span></p>
<p><span style="color: #000000;">2.  A <strong><span style="font-family: Times New Roman;">Guardian </span></strong></span><span style="color: #000000;">or <strong><span style="font-family: Times New Roman;">Trustee of the person</span></strong></span><span style="color: #000000;"> whose marriage is registered. </span></p>
<ul>
<li><span style="color: #000000;">The guardianship/trusteeship document must provide the authority (or not negate the authority) to make application for a marriage record; e.g., the document only authorizes banking privileges. </span></li>
<li><span style="color: #000000;">A copy of the guardianship court order or proof of trusteeship must be attached to the application form. </span></li>
</ul>
<p><span style="color: #000000;">3.  An individual who holds a <strong><span style="font-family: Times New Roman;">Power of Attorney</span></strong></span><span style="color: #000000;"> to act on behalf of the person whose marriage is registered.  </span></p>
<ul>
<li><span style="color: #000000;">The applicant must be identified in the power of attorney. </span></li>
<li><span style="color: #000000;">The power of attorney document must provide the authority (or not negate the authority) to make application for a marriage record; e.g., the document only authorizes banking privileges. </span></li>
<li><span style="color: #000000;">A copy of the power of attorney must be attached to the application form. </span></li>
</ul>
<p><span style="color: #000000;">4.  A <strong><span style="font-family: Times New Roman;">Designated Agent </span></strong></span><span style="color: #000000;">on behalf of an eligible person (#1 to #3). </span></p>
<ul>
<li><span style="color: #000000;">The applicant must have known the Designated Agent for at least one year. </span></li>
<li><span style="color: #000000;">The Applicant&#8217;s Consent to Designated Agent on the application form must be completed by an eligible applicant (#1 to #3). </span></li>
<li><span style="color: #000000;">The Designated Agent&#8217;s Statutory Declaration on the application form must be solemnly declared by the designated agent. </span></li>
<li><span style="color: #000000;">The original Consent and Statutory Declaration (if separate documents) must be attached to the application form. </span></li>
</ul>
<p><span style="color: #000000;">5.  An individual named the agent in a <strong><span style="font-family: Times New Roman;">Personal Directive </span></strong></span><span style="color: #000000;">of a person whose marriage has been registered.</span></p>
<ul>
<li><span style="color: #000000;">Fax a copy of the Personal Directive to Vital Statistics for evaluation. </span></li>
<li><span style="color: #000000;">Vital Statistics will advise if the applicant is eligible. See </span><a href="http://ags.ranet.reg.gov.ab.ca/Manuals/vistas/769.html"><span style="color: #0066cc;">Contacting Alberta Vital Statistics</span></a><span style="color: #000000;">. </span></li>
<li><span style="color: #000000;">The Personal Directive must show the applicant as the agent. </span></li>
<li><span style="color: #000000;">A copy of the Personal Directive must be attached to the application form when the applicant is eligible. </span></li>
</ul>
<p><span style="color: #000000;">6.  An individual who has an <strong><span style="font-family: Times New Roman;">Alberta Court Order</span></strong></span><span style="color: #000000;"> that states he/she may make an application for a particular certificate/certified copy of a Registration of Marriage. </span></p>
<ul>
<li><span style="color: #000000;">The applicant must be named in the court order as authorized to make application. </span></li>
<li><span style="color: #000000;">The court order must state whose certificate/certified copy of a Registration of Marriage is being released. </span></li>
<li><span style="color: #000000;">A copy of the court order must be attached to the application form. </span></li>
<li><span style="color: #000000;">Record the court order number in the Service Request Notes on VISTAS.</span></li>
</ul>
<p><span style="color: #000000;">7.  A <strong><span style="font-family: Times New Roman;">Lawyer</span></strong></span><span style="color: #000000;"> acting on behalf of any of the above eligible applicants (#1 to #6), when obtaining the marriage record is required as part of the service the lawyer is providing.</span></p>
<ul>
<li><span style="color: #000000;">A copy of the lawyer&#8217;s valid Law Society card must be attached to the application form. </span></li>
<li><span style="color: #000000;">The application must indicate who of the eligible applicants (#1 to #6) the lawyer is applying on behalf of. </span></li>
<li><span style="color: #000000;">A person working in the <strong><span style="font-family: Times New Roman;">same</span></strong></span><span style="color: #000000;"> law office as the eligible lawyer may make the application on the lawyer&#8217;s behalf. The person must show proof he/she is employed by the same law firm as the lawyer. A copy of the proof (e.g., the person&#8217;s business card, pay stub, letter of employment, etc.) must be attached to the application. This is in addition to the copy of the lawyer&#8217;s Law Society card.</span></li>

NUANS (Newly Upgraded Automated Name Search) is a computerized search system that, for the purposes of Corporate Registry, compares a proposed corporate name to a database of existing corporate names.  This comparison determines the similarity that exists between the proposed name and existing names in the database, and produces a listing of names that are found to be most similar.<br />
In most cases, the NUANS report will reserve the proposed name, for a period of 90 days, for the person requesting the report. Business Name Search Reports are different in that, while they provide a list of similar names, there is no exclusive reservation of the name.<br />
NUANS reports, whether they are sent to an authorized service provider or to the Corporate Registry office, must be less than 91 days old and must contain all 6 pages.  Either the original or a carbon copy is acceptable.</p>
